Terms of Service

These Terms of Service ("Terms") govern your use of the FilmRoom mobile application and website at getfilmroom.com (together, the "Service"), operated by FilmRoom ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use FilmRoom. If you are between 13 and 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

2. Account Registration

To use certain features, you must create an account using Apple Sign-In, Google Sign-In, phone number, or email. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.

3. The Service

FilmRoom provides AI-powered basketball shooting analysis. You upload or record video content, and our system processes it using computer vision and machine learning to provide coaching feedback, shooting metrics, and form analysis. The Service is provided "as is" and analysis results are for informational and training purposes only.

4. Your Content

You retain ownership of all videos and content you upload to FilmRoom ("Your Content"). By uploading content, you grant us a limited, non-exclusive license to process, store, and analyze Your Content solely to provide the Service to you.

You represent that you have the right to upload any content you submit, including the consent of any individuals appearing in your videos. You are responsible for ensuring your content does not violate the rights of others.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that is harmful, abusive, defamatory, or violates the rights of others
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Interfere with or disrupt the Service or its infrastructure
• Use automated means to access the Service beyond normal app usage
• Resell, redistribute, or sublicense the Service without our written consent
• Upload content depicting individuals without their knowledge or consent

6. AI-Generated Feedback

FilmRoom uses artificial intelligence to generate coaching feedback and analysis. This feedback is based on algorithmic analysis of your video content and should be treated as a supplementary training tool, not a replacement for professional coaching or medical advice. We do not guarantee the accuracy or completeness of AI-generated feedback.

Physical activity disclaimer: Basketball involves physical activity and risk of injury. Always consult with a qualified coach or medical professional before making significant changes to your training based on any feedback, including from FilmRoom. We are not responsible for injuries resulting from the use of our Service.

7. Intellectual Property

The Service, including its design, code, AI models, branding, and all related intellectual property, is owned by FilmRoom and protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as intended.

8. Pricing and Payments

FilmRoom is currently available for free during the early access period. We reserve the right to introduce paid features or subscription plans in the future. We will provide advance notice of any pricing changes.

9. Termination

You may stop using the Service and delete your account at any time by contacting us. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases, and we may delete your account data in accordance with our Privacy Policy.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FILMROOM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless FilmRoom and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in New York, New York.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
